GymGees — Custom Terms of Use / End User Licence Agreement

1. Acceptance of these Terms
These Terms of Use (the “Terms”) form a binding agreement between you and Travel Gym Bros LTD (“GymGees”, “we”, “our”, “us”), governing your use of the GymGees mobile application and any related services (together, the “Service”).
By downloading, installing, or using the Service you agree to be bound by these Terms. If you do not agree, do not install or use the Service. These Terms replace and supersede Apple’s Standard End User Licence Agreement on iOS and apply equally to users on Google Play and any other distribution channel.
2. Eligibility
The Service is intended for users aged 16 and over. By using GymGees you confirm that you are at least 16 years old. You are responsible for ensuring that your use of the Service complies with the laws of your country of residence.
3. Licence to use the app
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, install, and use the GymGees app on devices you own or control, for your personal, non-commercial use.
You may not:
- Copy, modify, distribute, sell, lease, sublicense, or create derivative works of the app or any part of it.
- Reverse engineer, decompile, or disassemble the app, except to the extent expressly permitted by applicable law.
- Remove or alter any proprietary notices, trademarks, or attributions.
- Use the Service to build a competing product, scrape data, or train machine-learning models.
- Circumvent or attempt to circumvent any security, rate-limiting, authentication, or feature-gating mechanism in the Service.
4. AI assistant (Coach) — important disclaimers
GymGees includes Coach, an AI-powered assistant that helps you plan training, log workouts, and track nutrition. You acknowledge and agree to the following before using Coach:
- Coach is not a personal trainer, nutritionist, doctor, or other qualified professional. Coach’s outputs are AI-generated suggestions intended for general informational purposes only.
- Coach can be wrong. AI models can produce inaccurate, incomplete, or unsafe outputs (“hallucinations”). You should not rely on Coach as the sole basis for any decision affecting your health, training, or nutrition.
- Consult qualified professionals. Always seek advice from a qualified medical practitioner, registered dietitian, or certified trainer before starting a new exercise programme, changing your diet significantly, or if you have any medical condition, injury, allergy, or are pregnant or breastfeeding.
- No automated decision-making. Coach does not make automated decisions that produce legal effects or significantly affect you in a similar way (Article 22 of the UK GDPR). Coach is an assistant; you remain in control of every decision.
- Your data is sent to an AI provider. When you use Coach, your messages and a structured snapshot of your relevant profile information (goals, recent workouts, dietary preferences, and — if you connect Apple Health or Health Connect — recent activity such as step and heart-rate summaries) are processed by our LLM provider (currently OpenAI) under contract. See our Privacy Policy for details.
5. Health, training, and nutrition disclaimer
Exercise carries inherent risks of injury. Following training programmes, performing exercises, attempting personal records, or making dietary changes based on information provided by GymGees (including Coach) is entirely at your own risk.
You agree that:
- You will not use the Service in place of professional medical, dietary, or training advice.
- You will warm up appropriately, use suitable equipment, and train within your ability.
- You will stop and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptoms during exercise.
- If you have any existing medical condition, injury, or are recovering from one, you will consult a qualified healthcare professional before acting on any suggestion from GymGees.
- Any health or fitness metrics shown in the app that are read from your device or a connected wearable — including steps, heart rate, heart-rate variability, calories burned, and sleep — are estimates provided for general fitness information only. They may be inaccurate or incomplete, and you must not rely on them to diagnose, treat, monitor, or manage any medical condition.
GymGees is not a medical device and does not provide medical-grade measurements or diagnoses. To the maximum extent permitted by law, we accept no liability for injury, illness, or loss arising from your use of the Service.
6. User-generated content
GymGees allows you to create and share content with other users — including but not limited to gym reviews, comments, chat messages, workout logs, challenges, photos, profile information, and recipes (“Your Content”).
6.1 Ownership and licence
You retain ownership of Your Content. By submitting Your Content to the Service you grant us a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, display, distribute, adapt, and otherwise use Your Content solely for the purpose of operating, promoting, and improving the Service.
You represent and warrant that you have all the rights necessary to grant this licence and that Your Content does not infringe any third-party rights.
6.2 Acceptable Content — what you must not post
You agree not to submit, upload, or transmit any content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, hateful, or racially or ethnically offensive.
- Promotes violence, self-harm, eating disorders, illegal substances, or unsafe training practices.
- Targets or harasses any individual or group, including other GymGees users.
- Constitutes spam, advertising, solicitation, or unauthorised commercial communication.
- Impersonates any person or entity, or misrepresents your affiliation with any person or entity.
- Infringes any copyright, trademark, trade secret, privacy, or other right of any party.
- Contains malware, viruses, or any other code designed to disrupt, damage, or limit the functionality of any software or hardware.
- Violates any applicable law, regulation, or these Terms.
The standards above apply to all surfaces of the Service including, without limitation, gym reviews, gym chats, community posts, workout invitations, profile fields, and any free-text input fed to Coach.
6.3 Reporting and moderation
If you encounter content or behaviour that violates these Terms, you can report it from within the Service (the reporting tools are surfaced on posts, profiles, reviews, and chats). Reports go to our moderation team for review.
We reserve the right (but not the obligation) to:
- Review any content submitted to the Service.
- Edit, remove, or refuse to display any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
- Suspend or terminate the account of any user who submits prohibited content or otherwise breaches these Terms.
- Cooperate with law-enforcement authorities and comply with valid legal requests.
6.4 Blocking other users
You can block any other user from within the Service. Blocking prevents the blocked user from contacting you, viewing your activity in shared surfaces, or interacting with your content.
7. Subscriptions and payments
7.1 Subscription tiers
Some features of GymGees (including Coach access at certain tiers) are available only through a paid subscription. The features included at each tier are described within the app and may change from time to time.
7.2 Purchase and billing
Subscriptions are purchased and billed through the Apple App Store (iOS) or Google Play (Android). Payment is charged to your iTunes / Google account upon purchase confirmation. We do not receive or store your payment card details.
7.3 Auto-renewal
- Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current subscription price.
- You can manage your subscription and turn off auto-renewal by going to your Apple ID account settings (iOS) or Google Play subscription settings (Android) after purchase.
- No cancellation of the current subscription is allowed during the active subscription period.
7.4 Refunds
All subscription purchases are final and non-refundable except where required by applicable law. Refund requests are handled by Apple or Google in line with their respective refund policies, not by us directly.
7.5 Price changes
We may change subscription prices from time to time. We will provide reasonable advance notice of any price increase, and the new price will apply from your next renewal. Your continued use of the subscription after the new price takes effect constitutes your acceptance of the new price.
7.6 Free trials and promotional offers
Where a free trial or promotional offer is provided, the conditions of the offer will be made clear at the point of acceptance. Unless you cancel before the trial or promotional period ends, you will be charged the standard subscription price thereafter.
8. Acceptable use of the Service
In addition to the content rules in section 6, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorised access to any part of the Service, other users’ accounts, or any connected systems.
- Interfere with or disrupt the integrity or performance of the Service (e.g. via excessive automated requests, denial-of-service attacks, or bypassing rate limits).
- Use any bot, scraper, or other automated means to access, copy, or harvest data from the Service.
- Create multiple accounts to abuse free-tier features, promotional offers, or referral programmes.
- Resell, sublicense, or commercially exploit the Service or any subscription you have purchased.
9. Your account
To use most features of GymGees you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials secure and confidential.
- Notify us promptly of any unauthorised use of your account.
- Be responsible for all activity that occurs under your account.
You can delete your account at any time from within the app. Account deletion removes your personal data in line with our Privacy Policy, subject to retention obligations under law.
10. Suspension and termination
We may suspend or terminate your account or restrict your access to the Service, with or without notice, if we reasonably believe that you have:
- Breached these Terms or any policy referenced in them.
- Engaged in conduct that may expose us, other users, or third parties to legal risk.
- Submitted prohibited content (see section 6.2).
- Attempted to circumvent security or feature-gating controls.
You may stop using and uninstall the Service at any time. Termination does not affect any rights or remedies that have accrued before termination.
11. Intellectual property
The Service — including the GymGees name, logo, app design, written content, AI prompts, and underlying code — is owned by Travel Gym Bros LTD or our licensors and is protected by copyright, trademark, and other laws. Except for the limited licence in section 3, no rights are granted to you by implication, estoppel, or otherwise.
12. Third-party services
The Service integrates with third-party platforms including the Apple App Store, Google Play, Apple Maps, Google Maps, Apple Health (HealthKit), Health Connect, OpenAI, Supabase, Sentry, PostHog, and others as listed in our Privacy Policy. Your use of those third-party services is governed by their respective terms. We are not responsible for the content, policies, or practices of any third-party service.
13. Warranties and disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties including, without limitation:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
- Warranties regarding the accuracy, reliability, or completeness of any content provided by Coach or any other AI-generated feature.
- Warranties regarding the accuracy or reliability of any health or fitness metric read from your device or a connected wearable (such as steps, heart rate, or calories burned).
- Warranties regarding the suitability of any training, nutrition, or health-related suggestion for your individual circumstances.
Nothing in this section limits any non-excludable consumer rights you may have under applicable law.
14. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, or other intangible losses arising from your use of (or inability to use) the Service.
- Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) GBP 100.
Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited under applicable law.
15. Indemnity
You agree to indemnify and hold harmless Travel Gym Bros LTD, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your access to or use of the Service; (ii) your breach of these Terms; or (iii) any content you submit to the Service.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date at the top and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. You agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any non-waivable rights you may have under the laws of your country of residence as a consumer.
18. Apple-specific terms (iOS only)
The following terms apply only when you have obtained GymGees through the Apple App Store and use it on an Apple device:
- These Terms are an agreement between you and Travel Gym Bros LTD, not with Apple. Apple is not responsible for the Service or its content.
- The licence granted in section 3 is limited to a non-transferable licence to use the app on any Apple-branded products that you own or control, subject to the Usage Rules set out in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support services for the Service. Any maintenance or support is our responsibility.
- Apple is not responsible for addressing any claims by you or any third party relating to the Service or your use of it, including (i) product-liability claims, (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy, or similar legislation.
- In the event of any third-party claim that the Service or your use of it infringes that third party’s intellectual-property rights, Travel Gym Bros LTD (not Apple) is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
- You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
19. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
20. Entire agreement
These Terms, together with our Privacy Policy and any other policies referenced in them, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
